Katy Perry is once again suing Katie Perry, dragging out her 14-year legal battle. Yeah, sounds confusing right? So, back in 2019 Australian fashion designer Katie Taylor - who sells her designs under her birth name Katie Perry - filed a suit against the ‘Dark Horse’ singer.
The Sydney-based designer started selling clothing under the name in 2007, and has had it registered as a trademark since 2008.
However, that same year, Katheryn Elizabeth Hudson had her first smash hits ‘I Kissed A Girl’ and ‘Hot N Cold’ under her stage name, you guessed it, Katy Perry.
In the designer’s suit, she claimed the singer sold clothing and merch in Australia in both 2014 and 2018, ignoring the trademark she already held. The two have been butting heads over rights and trademarks since 2009 now – Katy’s team want full ownership of the name and Katie simply won’t budge.
Earlier this year, the Australian Federal Court sided with Katie and ruled that the ‘The One That Got Away’ singer’s company, Kitty Purry, partially infringed her trademark.
While Justice Brigitte Markovic ruled that clothing sold for Katy Perry's 2014 tour did breach the trademark, she rejected further allegations relating to the sale of the singer's merchandise in stores and online in 2018.
The judge also dismissed a counter bid by the 13-time Grammy nominee to throw out the Katie Perry trademark altogether.
The designer told The New York Post it’s a ‘win for small business’ after revealing the star called her a ‘dumb b**ch’ in emails with her manager.
However, earlier this summer, Katy’s legal team filed an appeal. Katie said of the appeal: “This is a case that I thought had an end in sight and yet the singer has chosen to continue to drag it out.”
The Aussie said she’s expected back in court with the star in either November or December, adding: “My label is my future, my dream, my livelihood. And now there is a chance my trademark could be taken away.”
Though Katie has no plans to ‘stand down’ in this ‘David and Goliath case’.
She told RadarOnline: “It’s not in my nature. I’m a fighter and will always stand up for the underdog.”
When the outlet asked her if the whole thing was a stunt, Katie said: “There are far better ways for a fashion brand to get PR than having to go through absolute hell.”
The mum added that the ‘California Gurls’ singer’s persistence to get her way has taken up her time away ‘from my kids and my business’.
